Either way you stand a very good chance of having to pay dearly for a lawsuit. On one hand, you will have to spend significant money for E-Discovery, lawyers, and your senior management time and still risk losing because you missed a key piece of evidence. On the other hand, you may decide avoid all that by settling the case even if you feel you might have won in court.
This seems like an unintended consequence of the law’s revision, but forewarned is forearmed.
